REMOVAL OR RELAXATION OF GENERAL RESTRICTIONS
ON ACCESS LAND UNDER PT.1 OF C.R.O.W. ACT

Thank you for giving the Institute for Outdoor Learning the opportunity to comment on your consultation paper on the above subject. The Institute, as a registered charity, was formed two years ago as the result of the convergence of six outdoor organisations. We represent probably the broadest spectrum across the industry of any existing organisation. Our members include employers and employees involved in walking, mountaineering, personal development, outdoor activities, watersports and field studies. Our members are present in outdoor centres, educational establishments, some small providers and they may work for charities, local authorities, commercial enterprises or themselves.

The opportunity for landowners to allow greater use of their land and at the same time to reduce their legal liability to the level afforded by the above Act will benefit owners and the public who will gain not only from greater access but it could also be for a wider range of activities.

We would support option 3 (para 2.16 of the consultation document) because as legal liability is the core of this relaxation then it is necessary for clear guidance to be given to the relevant authorities but at the same time there is benefit in regulations that are flexible and have the minimum bureaucracy to ensure speedy responses and decisions.
